1. Agreement to Terms
These Terms of Service ("Terms") are a binding agreement between you and Keegan B. White, an individual doing business as HomeSquatch ("HomeSquatch," "we," "us," or "our"), governing your access to and use of the HomeSquatch mobile application and related services (collectively, the "Service").
By creating an account, checking the box presented at signup, or otherwise accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, do not use the Service.
2. Description of the Service
HomeSquatch is a home-management application that helps homeowners track home maintenance, view estimated home value and rental value, discover local home service providers, and receive relevant notifications about their property. The Service includes, among other things:
• An automatically generated home maintenance schedule based on details you provide about your home
• Estimated home value, rental value, and related market data sourced from third-party providers
• A directory of local home service businesses sourced from third-party mapping data
• General home-upgrade return-on-investment information sourced from third-party industry reports
• Notifications relating to maintenance timing, home value changes, nearby comparable sales, and, where applicable, weather events
The Service is intended for general informational and organizational purposes only. It is described in detail in Section 6 below, which you should read carefully, as it explains important limits on what the Service does and does not do.
3. Eligibility
You must be at least 18 years old and capable of forming a legally binding contract to use the Service. By using the Service, you represent that you meet these requirements. The Service is not directed to, and we do not knowingly collect personal information from, anyone under 18. See our Privacy Policy for more on this.
The Service is currently offered only to residents of, and for homes located in, the states of Washington and Oregon. We may expand or change this availability at our discretion.
4. Accounts
4.1 Registration
To use most features of the Service, you must create an account using an email address and password, or a supported third-party sign-in method (e.g., Google or Apple sign-in). You agree to provide accurate, current, and complete information during registration and to keep that information up to date.
4.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly at habtrakai@gmail.com if you suspect unauthorized use of your account.
4.3 One Account Per Person
Accounts are intended for individual homeowners or individuals managing a home on behalf of its owner. You may not create an account on behalf of someone else without their authorization.
5. Information You Provide
To generate a maintenance schedule, value estimates, and other features, you will be asked to provide information about your home, including but not limited to its address, type, age, size, systems, appliances, and features. You represent that the information you provide is accurate to the best of your knowledge. The accuracy and usefulness of the Service's outputs (maintenance schedules, value estimates, and recommendations) depend directly on the accuracy of the information you provide.
6. Important Disclaimers About the Service
Please read this section carefully. It describes real, material limitations on what the Service provides.
6.1 Home Value and Rent Estimates Are Not Appraisals
Estimated home value and estimated rental value shown in the Service are automated valuation model ("AVM") estimates provided by a third-party data provider (currently RentCast). These are statistically generated estimates based on available market data, not appraisals, inspections, or guarantees of actual market value. They may be inaccurate, may not reflect the condition of your specific home, and should not be relied upon as the sole basis for any financial, lending, insurance, tax, or sale-price decision. Obtain a licensed appraisal or comparative market analysis from a qualified professional before making decisions of that kind.
6.2 Maintenance Schedules Are General Guidance
Maintenance tasks and their suggested timing are generated using general rules based on your home's stated features and regional seasonal patterns. They are general guidance only, are not a substitute for your equipment or appliance manufacturer's specific instructions, a professional home inspection, or the judgment of a licensed contractor, and are not guaranteed to be complete, accurate, or appropriate for your specific home, climate microzone, or equipment.
6.3 Service Provider Listings Are Not Vetted, Endorsed, or Guaranteed
Businesses shown in the Service's marketplace/search features are sourced from third-party mapping and business-listing data (currently Google Places). We do not independently verify the licensing, insurance, bonding, background, qualifications, pricing, or work quality of any business shown, and we do not employ, endorse, recommend, or guarantee the work of any listed business. You are solely responsible for vetting any provider (including verifying licensing and insurance) before hiring them. Any contract, transaction, or dispute you enter into with a provider is solely between you and that provider; we are not a party to it.
6.4 Upgrade / ROI Information Is General, Not Personalized
Estimated return-on-investment figures for home improvement projects are drawn from a third-party published industry report reflecting regional or national averages for a given project type. They are not appraisals or estimates specific to your home, do not account for your local contractor pricing, and actual results may vary substantially, including negatively.
6.5 Weather Alerts Are Informational Only
Where provided, weather-related notifications are sourced from the U.S. National Weather Service and are intended to give general awareness and preparation suggestions. They are not a substitute for official emergency alerts, guidance from local authorities or emergency services, or your own judgment in an emergency. Do not rely on the Service as your sole source of emergency or safety information.
6.6 Not Professional Advice
Nothing in the Service constitutes financial, legal, tax, insurance, real estate, engineering, contracting, or other professional advice. Consult a qualified, licensed professional for advice specific to your situation before making significant decisions about your home.
7. Acceptable Use
You agree not to:
• Use the Service for any unlawful purpose or in violation of these Terms
• Provide false information about yourself or a home you do not own or have authority to manage
• Attempt to gain unauthorized access to the Service, other users' accounts, or our systems
• Interfere with or disrupt the integrity or performance of the Service
• Scrape, harvest, or otherwise extract data from the Service using automated means, except as permitted by our robots.txt or with our prior written consent
• Use the Service to harass, defraud, or harm any person or business, including businesses listed in the marketplace
• Reverse-engineer, decompile, or attempt to derive the source code of the Service, except to the extent applicable law prohibits this restriction
8. Third-Party Services
The Service integrates data and functionality from third-party providers, including RentCast (home value/rent data), Google (business listing data, mapping, and location services), and the U.S. National Weather Service (weather alert data), among others we may add or change over time. These third parties are not affiliated with HomeSquatch, operate under their own terms and privacy practices, and we do not control and are not responsible for the accuracy, availability, or content of their data. Your use of features relying on third-party data may also be subject to that third party's own terms of use.
9. Fees
The service is currently offered free of charge. If HomeSquatch introduces paid features, subscriptions, or provider-advertising products in the future, this section will be updated to describe applicable fees, billing terms, refund policy, and auto-renewal disclosures before those features launch, and your continued use after such an update will be subject to the terms then in effect.
10. Intellectual Property
The Service, including its design, text, graphics, logos, the HomeSquatch name and mascot, and underlying software, is owned by Keegan B. White or HomeSquatch's licensors and is protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. All rights not expressly granted are reserved.
Home value, rent, comparable sale, business listing, and weather data displayed through the Service remain the property of their respective third-party providers and are provided for your personal use within the Service only.
11. User Content
If you submit feedback, bug reports, feature requests, or other content to us ("Feedback"), you grant us a perpetual, irrevocable, worldwide, royalty-free license to use that Feedback for any purpose, including improving the Service, without obligation or compensation to you.
12. Termination
You may stop using the Service and request deletion of your account at any time as described in our Privacy Policy. We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent or harmful conduct, or for any other reason at our discretion, including discontinuation of the Service. Sections of these Terms that by their nature should survive termination (including Sections 6, 10, 13, 14, 15, and 16) will survive.
13. Disclaimer of Warranties
THE SERVICE AND ALL CONTENT, DATA, AND RECOMMENDATIONS PROVIDED THROUGH IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY ESTIMATE, RECOMMENDATION, SCHEDULE, OR LISTING PROVIDED THROUGH THE SERVICE IS ACCURATE, COMPLETE, OR SUITABLE FOR YOUR PARTICULAR HOME OR CIRCUMSTANCES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HOMESQUATCH AND ITS REPRESENTATIVES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, ANY DECISION MADE OR ACTION TAKEN IN RELIANCE ON INFORMATION FROM THE SERVICE, OR ANY DEALING WITH A SERVICE PROVIDER FOUND THROUGH THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, HOMESQUATCH'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID HOMESQUATCH IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) $100 USD.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
15. Indemnification
You agree to indemnify, defend, and hold harmless HomeSquatch and its representatives, contractors, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your misuse of the Service, or your dealings with any service provider or third party found through the Service.
16. Dispute Resolution; Governing Law
These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws principles.
17. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice through the Service or by other reasonable means before the changes take effect. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
18. General Provisions
18.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and HomeSquatch regarding the Service and supersede any prior agreements.
18.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
18.3 No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
18.4 Assignment
You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
